SPOUSAL ABUSE/DOMESTIC VIOLENCE

Domestic violence or spousal abuse charges can result in being sent to prison in this state, and thus should be taken extremely seriously. A conviction can occur of the prosecutor can prove beyond a reasonable doubt that you "intentionally or recklessly caused or attempted to cause bodily injury, or placed another person in reasonable apprehension of imminent, serious bodily injury to himself, herself or another." Your victim can be a partner, child, spouse, girlfriend or boyfriend, or an elderly member of the family. Because domestic abuse is so common statistically, and because the nature of the crime is such that the accused almost always has an alleged motive, means and opportunity to commit it, the stigma against the merely accused is generally very strong. Ironically, your spouse or family member oftentimes will deny that she was abused (because no one wants to get the police involved, or for the abuser to go to jail and be unable to work, or to lose the custody of children, or to have a criminal record), but the police often can and will arrest you regardless. Likewise, the government can prosecute and convict you even without the victim's cooperation or desire to press charges.
